85　 Restrictions on use of non-human hominids　85 人間以外のヒト科動物の使用の制限

（1）No person may carry out any research, testing, or teaching involving the use of a non-human hominid unless such use has first been approved by the Director-General and the research, testing, or teaching is carried out in accordance with any conditions imposed by the Director-General.　何人も、人間以外のヒト科の動物の使用を含む研究、実験又は教育を行うことができない。ただし、それが第１次産業省長官によってはじめに承認された使用であり、その研究、実験又は教育が第１次産業省長官によって課せられるあらゆる条件に従ってなされる場合は、この限りではない。

（2）The Director-General may, in giving approval under subsection (1), impose, as conditions of that approval, such conditions as the Director-General thinks fit.　 (1) のもとで承認を与える第１次産業省長官は、その承認の条件として、当該長官が適切と考える条件を課すことができる。

（3）The Director-General may from time to time, by notice in writing to any person holding an approval under subsection (1),―　第１次産業省長官は、文書による通知により、 (1)のもとで承認を得る人々に対して、適宜、次のことを行うことができる。

　　(a) revoke any condition of that approval:  　　　　承認条件の撤回。　　(b) revoke any condition of that approval, and impose another condition in its place:  　　　　承認条件の撤回と、それに変わる他の条件を課すこと。　　(c) amend any condition of that approval.  　　　　承認条件の修正。

（4） The Director-General must consult with the National Animal Ethics Advisory Committee before exercising the powers conferred by subsection (1) or subsection (2) or subsection (3). 　第１次産業省長官は、(1)、 (2)又は (3)にかかる執行権を行使する前に、国立動物倫理諮問委員会に相談をしなければならない。

（5） The Director-General must not give approval under subsection (1) unless he or she is satisfied―　第１次産業省長官は、申請者が次のことを満たしていない場合に、(1)のもとで承認を与えてはならない。

　　(a) that the use of the non-human hominid in the research, testing, or teaching is in the best interests of the non-human hominid; or  　　　　その研究、実験又は教育における人間以外のヒト科の動物の使用が、人間以外のヒト科の動物にとって最大の利益となる場合。又は

　　(b) that the use of the non-human hominid in the research, testing, or teaching is in the interests of the species to which the non-human hominid belongs and that the benefits to be derived from the use of the non-human hominid in the research, testing, or teaching are not outweighed by the likely harm to the non-human hominid.　　　　その研究、実験又は教育における人間以外のヒト科の動物の使用が、人間以外のヒト科の動物が属する種のためになり、かつ、その研究、実験又は教育における人間以外のヒト科の動物の使用による利益が、人間以外のヒト科の動物に対して与える可能性のある危害よりも上回らない場合。

（6）The Director-General must monitor the carrying out of any research, testing, or teaching to which an approval given under subsection (1) relates.  　第１次産業省長官は、(1)の元で与えられた承認に関連する研究、実験又は教育の実施を監視しなければならない。

（7）A person commits an offence who contravenes subsection (1).  　(1)を違反するものは罪に服す。

（8） Nothing in sections 82 to 84 applies in relation to research, testing, or teaching that involves the use of a non-human hominid.  　82節から84節のすべての条項は、人間以外のヒト科の動物の使用を含む研究、実験又は教育に関して適用されない。

A person who commits an offence against section 82(2) or section 83(2) or section 84A(3) or section 85(7) is liable on conviction, ―第82(2)節、第83(2)節、第84A(3)節又は第85(7)節のいずれかに対して規則違反を犯す者は、次の有罪判決の責任を負う。

(a) in the case of an individual, to imprisonment for a term not exceeding 6 months or to a fine not exceeding $25,000 or to both; and 個人の場合、６ヶ月を超えない懲役、$25,000を超えない罰金、又はその両方に処する。

(b) in the case of a body corporate, to a fine not exceeding $125,000.　法人の場合、$125,000を超えない罰金に処する。
